Terms of sale

The rules for using this site and buying a kit. Written to be read, not to hide anything.

These terms cover using this website and buying a kit from us. Nothing here takes away your rights under the Australian Consumer Law.

About these terms

These terms are an agreement between you and AccuGuard (ABN 82 698 774 293). They apply when you use accuguard.com.au and when you buy anything from us. By placing an order you accept them, so please read them first.

We may update these terms. The version that applies to your order is the version on this page when you placed it.

Using this website

You can browse, read and share this site freely. You agree not to interfere with it, scrape it at a volume that affects other people, or use it to break the law.

We try to keep the site accurate and available, and we cannot promise it will never be wrong or offline.

The waitlist

Joining the waitlist is free and does not commit you to buying anything. It also does not reserve stock or guarantee a kit for your car will exist. If we say a waitlist price applies at launch, we will honour it for the period we state in that email.

Orders

An order is an offer to buy. A contract forms when we send you an order confirmation email, not when you pay.

We can decline or cancel an order, and refund you in full, if the item is out of stock, if the price or description was wrong, if we cannot verify your details, or if we suspect fraud.

Tell us within 2 hours if you need to change or cancel an order. Once a kit is picked and packed we may not be able to stop it, and the returns policy takes over from there.

Pricing and payment

Prices are in Australian dollars and include GST. Delivery is charged separately unless we say otherwise.

If a price is obviously wrong, for example a decimal point in the wrong place, we can cancel the order and refund you rather than honour it. We will tell you before we do.

Payment is taken at checkout through our payment provider. Title to the goods passes to you when we receive payment in full, and risk passes when they are delivered to you.

Delivery timeframes, costs and what happens to a lost parcel are in our shipping policy.

Fitment and your responsibility

Every kit is cut from a pattern for a specific make, model and year, and sometimes a specific variant. You are responsible for giving us the right vehicle details. If a kit does not fit because the details you gave were wrong, that is a change of mind under the returns policy rather than a fault.

Fitting is done by you, on your own car, at your own risk. Paint that is already damaged, resprayed, poorly repaired or peeling can lift when film is applied or removed. Check the panels first, and tell us if you are unsure, because we cannot be responsible for the condition of paint we have never seen.

Follow the instructions in the kit and in the video guide. Damage caused by working outside those instructions is not covered by warranty.

Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Any warranty we offer sits on top of those rights and does not replace them. How to make a claim is set out in the returns and warranty policy.

Our liability

Nothing in these terms limits your rights under the Australian Consumer Law. Where the law allows us to limit our liability, our liability for a fault in the goods is limited, at our election, to replacing the goods, supplying equivalent goods, repairing them, or paying the cost of any of those things.

To the extent the law allows, we are not liable for loss you could not reasonably have expected, or for loss caused by installing the film in a way the instructions tell you not to.

Content and intellectual property

The AccuGuard name, logo, photography, videos, written guides and cut patterns belong to us or our licensors. You may use them to fit your own kit and share them personally. You may not copy the patterns, resell the guides, or use our branding commercially without written permission.

Vehicle manufacturer names and badges shown on this site belong to those manufacturers and are used to identify which cars our kits fit. We are not affiliated with, endorsed by or sponsored by any vehicle manufacturer.

The video guide

The guide is general instruction, not advice about your specific car. Conditions on the day matter: temperature, wind, the state of your paint and how carefully the surface was prepared. Use your judgement, and call us if something does not match what you are seeing.

Disputes

If something goes wrong, contact us first. Most problems are sorted in a couple of emails. If we cannot settle it between us, either of us can take it to the relevant consumer body or court.

General

These terms are governed by the laws of Western Australia and the courts of Western Australia have jurisdiction. If part of these terms is unenforceable, the rest still applies. Not enforcing a term straight away does not mean we have given it up.
